Zandas & Zandas [2014] is a case that demonstrates that family law clients are best served by seeking assistance from solicitors who specialise in family law. The case went disastrously wrong for the husband due to the inexperience of his lawyer.
His family law trial had to be adjourned after two days of court time as the judge said, “the Husband’s case was nowhere near ready to proceed.” The Husband was ordered to pay the full fees of the Wife’s solicitor and barrister for the two days at court.
The judge questioned the expertise and experience of the husband’s barrister and solicitor in family law. He said, “The day has long passed when solicitors can “dabble” in family law” and “the solicitor … has certainly not shown the degree of competence that the Court would expect.”
The judge also said “A party with a family law matter should consult a solicitor with proven expertise in the jurisdiction. The Law Society of New South Wales is able to provide to members of the public information about lawyers who practice in various jurisdictions.”
